By choosing to work with Génoa, you agree to be bound by the terms of this policy. Please read these conditions carefully.
1. Access to the Platform
Access to the Génoa platform is available through the following two methods:
• By login credentials: The user connects using a username and password provided to them.
• By self-registration: The user creates their own account on the platform.
Course enrollment is managed according to the method established by the company or the trainer responsible for the course. Génoa does not intervene in this enrollment process.
2. Use of the Platform
It is strictly forbidden to use the Génoa platform or third-party services accessible through it to engage in illegal, fraudulent, defamatory, privacy-infringing, or any other activities that may harm Génoa, its users, or third parties.
If Génoa is informed that a client has used a Génoa service or a third-party service to engage in any of the aforementioned activities, the client’s account will be terminated without prior notice.
Account Termination and Data Deletion:
In the event of account termination, all associated data will be permanently deleted. Once the account is closed, the data will no longer exist and cannot be recovered under any circumstances. The client will be notified of the account closure within a reasonable time before data deletion.
3. User Accounts
User accounts are strictly personal and non-transferable. Each user is fully responsible for maintaining the confidentiality and security of their login credentials, especially their password. It is strongly recommended to choose a strong password and to change it regularly.
4. User Content
The user is solely responsible for the content they publish, upload, or share on the platform (course materials, forum posts, chat messages, etc.).
Génoa reserves the right to remove any material it deems, at its sole discretion, to be in violation of applicable laws or regulations, to infringe on third-party rights, or to cause distress to other users of the services provided by Génoa.
Génoa cannot be held liable for any user content that infringes upon third-party intellectual property rights. It is the user’s responsibility to ensure that they hold all necessary rights to the content they share.
4 bis. Media Hosting Limitation
To maintain platform performance and stability, uploading large media files—particularly videos and images exceeding 500 KB—is strictly prohibited.
Users wishing to include video content are advised to host their videos on specialized platforms such as YouTube or Vimeo and embed the corresponding links within the designated areas.
Failure to comply with this rule may result in the removal of the offending content and, in the case of repeated violations, suspension of the user account.
5. Intellectual Property
Génoa remains the sole owner of all intellectual property rights related to its platform and proprietary areas, referred to as “Genoa Learning” (including structure, design, features, software, etc.), with the exception of user content.
Each company or trainer retains full ownership of the intellectual property rights over their dedicated space within the platform, excluding content created and published by users of that space.
6. Liability
To the fullest extent permitted by applicable law, Génoa shall not be held liable for any direct, indirect, consequential, or incidental losses or damages arising from the use or misuse of the services, temporary or permanent service unavailability, or deletion of accounts and data in accordance with these Terms of Use.
Génoa shall not be held responsible for the content of external websites linked to from the platform. The presence of such hyperlinks does not imply endorsement or approval of the content on those external sites.
7. Modification of Services and Terms of Use
Génoa reserves the right to modify its services and these Terms of Use at any time and without prior notice, particularly to comply with legal, regulatory, technical, or business developments.
Users will be informed of any substantial changes by any means deemed appropriate by Génoa (e.g., platform notifications, email, etc.).
It is recommended to consult the Terms of Use regularly to stay informed of any updates. Continued use of the services after the publication of changes will constitute acceptance of those changes.
8. Governing Law and Jurisdiction
These Terms of Use are governed by and interpreted in accordance with French law.
In the event of a dispute concerning the interpretation, performance, or validity of these Terms, and in the absence of an amicable resolution, the competent French courts shall have exclusive jurisdiction, including in cases involving multiple defendants or third-party claims.
